Terms and Conditions
CliniLink Academy (operated by CliniLink Ltd)
These Terms govern your use of CliniLink Academy, our digital learning platform at www.clinilinkacademy.com. They should be read alongside our Privacy Policy and our Cookie Policy.
If you are attending a CliniLink event or webinar, separate Terms and Conditions apply and are available at https://clinilink.co.uk/terms-and-conditions.
1. Introduction and Agreement to Terms
1.1CliniLink Academy is operated by CliniLink Ltd ("CliniLink", "we", "us", "our"), a company registered in England and Wales under company number 16243215, whose registered office is at Stockport Pyramid, Yew Street, Stockport Trading Estate, Stockport, SK4 2JZ. ICO Registration Number: ZB896601.
1.2CliniLink Academy is a trading platform of CliniLink Ltd. It is not a separate legal entity and holds no separate registration with the Information Commissioner’s Office. CliniLink Ltd is the data controller for all personal data processed through the platform.
1.3By creating an account or using the platform you agree to these Terms. If you do not agree, please do not use the platform.
1.4We may update these Terms from time to time as described in section 15. The version in force is always the one published on the platform.
2. Eligibility
2.1The platform provides continuing professional development for healthcare professionals. It is intended for use by healthcare professionals registered with a UK regulator, including the GPhC, GMC, NMC and PSNI, and by other persons working in or training for UK primary care roles.
2.2You must be at least 18 years of age to create an account.
2.3Certain courses or areas of the platform may be restricted to particular professional groups. Where content is sponsored or funded by a pharmaceutical company, access may require confirmation of your professional status as described in section 6.
3. Your Account
3.1You must provide accurate and complete information when registering, including your name, email address and, where requested, your professional registration number, and keep this information up to date.
3.2Your account is personal to you. You must not share your login credentials with any other person or allow any other person to access the platform through your account. CPD certificates are issued to the named account holder only, and a certificate obtained through a shared account may be invalid for revalidation purposes.
3.3You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly if you believe your account has been accessed without authorisation.
3.4We may suspend or close accounts that breach these Terms as described in section 14.
4. Courses and Content
4.1The platform provides e-learning courses, modules, assessments and related educational materials. Some content is free of charge and some content may be paid or subscription based.
4.2Course content is provided for educational purposes only. It does not constitute clinical advice for any individual patient, and it does not replace your professional judgement, your employer’s policies or applicable clinical guidance. You remain responsible for your own clinical decisions.
4.3We take reasonable care to ensure content is accurate and current at the time of publication. Clinical practice, licensing and guidance change, and you should always verify information against current official sources before relying on it in practice.
4.4We may update, replace or retire courses at any time. Where a paid course is retired, section 8 applies.
5. CPD Certificates
5.1On successful completion of an eligible course you will be issued a CPD certificate in the name of the account holder.
5.2Where you have provided a professional registration number, it may appear on your certificate to support your revalidation record.
5.3Certificates evidence completion of the learning activity. They do not confer any qualification, licence or scope of practice.
6. Sponsored and Pharmaceutical Company Funded Content
6.1Some educational activities on the platform are commissioned, funded or sponsored by pharmaceutical companies. All such activities are delivered in line with the ABPI Code of Practice, and the involvement of the funding company is always declared.
6.2Where an activity contains promotional content, we will tell you before you register for it: who developed the content; who commissioned and funded it; whether the funding company developed, wrote, reviewed, approved or certified any part of it; that the activity is promotional; and which parts contain information about a medicine. The company will be named.
6.3Access to such an activity requires you to confirm that you are a UK registered healthcare professional and that you agree to access promotional content which may have been developed by or on behalf of the named company.
6.4The content of these activities, and the emails we send about them, may be developed, written, reviewed, approved or certified by, or on behalf of, the pharmaceutical company concerned, and may contain promotional content about that company’s medicines. Where we send you such an email, we do so on behalf of that company as well as on our own behalf, and only where you have given us the separate prior permission described in section 7.
7. Email Communications and Marketing Permissions
7.1Service emails. When you use the platform we send transactional service emails relating to your account and your learning, for example enrolment confirmations, receipts and CPD certificate emails. These relate to the service you have chosen to use, contain no promotional content and are not marketing.
7.2CliniLink marketing. With your permission, or where permitted by law, we may send you emails about CliniLink’s own educational programmes, events and platform updates. You can opt out at any time using the unsubscribe link in every such email.
7.3Emails about pharmaceutical company funded programmes. We send emails about educational programmes funded by pharmaceutical companies only where you have given us separate, explicit prior permission. The permission we ask for reads as follows:
7.4This permission is requested through an unticked, optional tick box at account registration, and, for learners who registered before this mechanism was introduced, through a one time prompt presented on the platform. Giving this permission is entirely optional and does not affect your access to any course.
7.5Each permission decision is recorded with the date, the wording version and the point of capture. The most recent choice you make is the one we honour, so a later decline overrides any earlier permission. You can withdraw this permission at any time using the unsubscribe link in every such email or by contacting us.
7.6Permissions given to CliniLink Ltd through www.clinilink.co.uk or www.clinilinkacademy.com are held by CliniLink Ltd as a single controller and are recorded in a single register, so a withdrawal made on either property takes effect across both.
8. Payments, Subscriptions and Refunds
8.1Prices for paid courses and subscriptions are displayed on the platform at the point of purchase and include VAT where applicable.
8.2Payment is taken at the point of purchase through our payment provider. Subscriptions renew automatically until cancelled, and you can cancel at any time with effect from the end of the current billing period.
8.3Where you purchase digital course content and begin accessing it immediately, you acknowledge that you lose the statutory right to cancel once access has begun, to the extent permitted by the Consumer Contracts Regulations 2013.
8.4If we permanently retire a paid course before you have had a reasonable opportunity to complete it, we will offer you a comparable alternative or a proportionate refund.
9. Intellectual Property
9.1All content on the platform, including courses, videos, assessments, text, graphics and branding, is owned by or licensed to CliniLink Ltd and is protected by intellectual property law.
9.2We grant you a personal, non transferable, non exclusive licence to access and use the content for your own professional education. You must not copy, record, distribute, sell, share or make the content available to any third party without our prior written consent.
10. Acceptable Use
10.1You must not use the platform in any way that is unlawful, that infringes the rights of others, or that could damage, disable or impair the platform.
10.2You must not attempt to gain unauthorised access to any part of the platform, other accounts, or the systems on which the platform is hosted.
10.3You must not complete assessments on behalf of another person or permit another person to complete assessments on your behalf.
11. Availability and Changes to the Platform
11.1We aim to keep the platform available at all times but do not guarantee uninterrupted access. The platform may be unavailable during maintenance, updates or events outside our reasonable control.
11.2We may change the features, functionality or appearance of the platform at any time.
12. Data Protection
12.1CliniLink Ltd is the data controller for personal data processed through the platform. How we collect, use and protect your personal data, including your professional registration number and your marketing permissions, is set out in the CliniLink Academy Privacy Policy, which forms part of these Terms.
13. Liability
13.1Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under the law of England and Wales.
13.2Subject to clause 13.1, we are not liable for any loss or damage arising from your reliance on course content in clinical practice, from unavailability of the platform, or from any indirect or consequential loss.
13.3Subject to clause 13.1, our total liability to you in respect of paid content is limited to the amount you paid for the relevant course or subscription in the 12 months preceding the claim. For free content, the platform is provided free of charge and, subject to clause 13.1, we accept no liability arising from its use.
14. Suspension and Termination
14.1We may suspend or terminate your account if you breach these Terms, including sharing your credentials, misusing content or providing false professional information.
14.2You may close your account at any time by contacting us. Closure of your account does not affect certificates already issued, although we recommend downloading them first.
15. Changes to these Terms
15.1We may amend these Terms from time to time. Material changes will be notified on the platform or by email, and the updated version will state its effective date. Your continued use of the platform after the effective date constitutes acceptance of the amended Terms.
16. General
16.1If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
16.2These Terms are personal to you and you may not assign them. A failure by us to enforce any provision is not a waiver of it.
16.3These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and CliniLink Ltd in relation to the platform.
17. Governing Law
17.1These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your local courts.
